Attorney General in Indiana Fights Back Against Unlawful Predictive Dialer Use

By Jamie Epstein, TMCnet Web Editor

It was recently revealed that Indiana Attorney General Greg Zoeller has granted a temporary restraining order against a Florida company that leveraged a predictive dialer to power more 660 illegal calls that were meant to provide Indiana residents with information about medical alert devices.

Out of those hundreds of calls, the company named Safeline Alert or Elite Information Solutions is accused in a new lawsuit of calling over 620 people registered on Indiana's Do Not Call list between June and August. And 540 of the complaints say the message they received was via dialer technology, an act which does not fall in line with rigorous mandates that come from the Indiana Auto-Dialer Act.

"In this case, the attorney general's office successfully received a temporary restraining order to help stop Hoosiers from receiving any more of these unwanted calls," Zoeller commented in a recent article.

He added, "These actions should send a strong message to those businesses violating the state's strict telephone privacy laws. Our office acknowledges that our Do Not Call law is not impervious to those who intend to deceive Hoosiers and break the law."

Originally filed in Marion County, the defendant is being called out for going against Indiana's Auto-Dialer and Do Not Call law. In addition, the company Safeline Alert is reported not to have a certificate of authority from the Indiana Secretary of State, something that is mandatory to run a business in the state.

If the defendant is found guilty of these actions, retribution will be sought in the form of attorney fees, consumer restitution, civil penalties and a permanent injunction against future calls.

In other predictive dialer news, InsideSales.com (News - Alert), a company that seamlessly integrates predictive dialer technology with a hosted CRM, is behind the PowerDialer platform which boasts Predictive 2.0 functionality and stands apart from other dialers due to the fact that it doesn’t abandon calls.

Just recently, the predictive dialer provider was awarded with $4 million in Series A Round funding from Hummer Winblad (News - Alert). This capital will be utilized to expand the company’s big data analytics sales force automation (SFO) technology.

Showing significant growth in just the last few months alone, InsideSales.com has grown its employee base from 65 to 140 people, while its range of customers have also grown dramatically from 600 to 900 customers.
