Telemarketers Using Predictive Dialers Should Adhere to Do Not Call Rules or Else

Predictive dialers are ideal to a variety of businesses; however the service is bound by several regulations such as the Do Not Call register that strictly prohibits telemarketers from making unsolicited calls to those who have joined this growing list.


Governments across the world have made the Do Not Call register more stringent and are implementing stricter laws to enforce it. Recently, an Australian financial solutions provider has been issued an infringement notice for violating the Do Not Call Register.

Ordered to Heritage Financial Solutions upon allegations that it had been calling numbers that were listed on ACMA’s Do Not Call Register, an investigation found that calls promoting Heritage Financial Solutions were made without the finance company first checking the numbers against the register, an act that is illegal in Australia.

Following the allegations, the company has been charged with a fine of nearly $17,000 that must be made the ACMA. According to ACMA, the financial solutions company has not adequately supervised the activities of the organization’s telemarketers. 

This instance further proves the growing importance of predictive dialers that abide by the rules and regulations advocated by law enforcement agencies, says NooJee Telephony Solutions Director Brett Sutton.

“Australian companies are fully aware that it is illegal for fax marketers or telemarketers to make any form of contact to people that have put their names down on the Do Not call Register. That could be a registered mobile phone, fixed line or fax number,” Sutton added in a statement.

Following the implementation of the Do Not Call Register (DNCR), there has been a significant decrease in unsolicited telemarketing calls. According to a research conducted by ACMA, 88 percent of the people with registered numbers on the Do Not Call Register (DNCR) noted receiving a decreased amount of telemarketing calls.

Charities, religious and public interest organizations are exempt from the Do Not Call register yet any other organization must ensure that they know who their telemarketers are calling at all times to avoid penalties such as those Heritage Financial Solutions is currently suffering from.
