Probation given to bouncer

Jan 08, 2013 (The Dominion Post - McClatchy-Tribune Information Services via COMTEX) -- A man charged with setting up a patron to be severely beaten in front of a former downtown nightspot was sentenced to two years probation Monday.

Naeen "Sho" Neal, of Morgantown, pleaded guilty to conspiracy to commit battery, a misdemeanor, for a Jan. 1, 2012, incident in front of Club O2, which was on Walnut Street.

Assistant Prosecuting Attorney Perri DeChristopher said Neal, a bouncer at O2, called the victim over and others beat and kicked him until he lost consciousness.

DeChristopher said there was an "unspoken policy" at O2 to physically remove or assault people deemed troublesome.

Three other men were charged in connection with beatings at O2. Two have pleaded guilty.

Marcus Penrose, an Osage resident who also worked as a bouncer, will be sentenced later this week for two counts of unlawful assault and one count of first-degree robbery for incidents outside O2 on Nov. 19, 2011, and Jan. 1, 2012, related to three victims, according to the prosecuting attorney's office.

Nicholas Carbacio, the former owner of O2, pleaded no contest to conspiracy to commit battery.

Like Neal, he is also accused of conspiring in, but not participating in, the beating of a man Jan. 1, 2012, DeChristopher previously said.

The case against Jermaine Davis, of Masontown, is still pending. He was indicted for malicious assault and conspiracy.

DeChristopher did not oppose Neal being placed on probation because he has no criminal record and was cooperative with police.

Neal apologized in court.

Monongalia County Circuit Judge Russell Clawges suspended a oneyear jail sentence in favor of probation. He stipulated that Neal must get a full-time job or go to college, must complete 100 hours of community service, and cannot work at a bar or a nightclub.
