Midland man arrested on federal child pornography charges

Jan 12, 2013 (Odessa American - McClatchy-Tribune Information Services via COMTEX) -- A Midland man was arrested and charged with possession and distribution of child pornography in federal court.

Jose Rangel was arrested Wednesday and charged Thursday after federal agents discovered six files uploaded consisting of child pornography, according to the federal complaint.

Homeland Security Investigation agents in Lubbock determined on Sept. 19 that six files were uploaded from a specific address, according to the complaint, and began an investigation.

The agents then downloaded four of the files, each with videos of children under 18 years old engaging in sexually explicit activity, according to the complaint, including one that lasted one hour and 46 minutes.

Agents traced the Internet address back to 409 W. Spruce Ave., Midland, according to the complaint.

Midland special agents then obtained a search warrant for the address on Jan. 9, at which point they seized a desktop computer and an external hard drive, according to the complaint.

When it was searched, agents found eight videos of child pornography, according to the complaint, and at least two depicted children under 12 engaging in sexual activity.

Rangel was interviewed by special agents and said he is the only one who uses the computer and hard drive, which he said he uses mainly for business purposes, according to the complaint.



However, when asked about the Ares Galaxy program on the computer, Rangel said he used the program to search for music and pornography, according to the complaint.

He then said "there's some bad stuff on there," according to the complaint, but denied intentionally downloading child pornography. Rangel then said in the interview he inadvertently downloaded child pornography, at which point he was arrested for the possession of child pornography.

If convicted, Rangel could face between five years and 20 years in federal prison, with a maximum fine of $250,000.
