County files lawsuit against Plant Maintenance Services

Ector County filed a lawsuit against a local company on Pearl Street Friday, stating in its complaint that the company has allowed hazardous waste barrels to collect on their property for almost eight years.
Ector County Environmental Enforcement officer Ted Yelley was contacted by a former employee for Plan Maintenance Services and was told the company had numerous 55-gallon drums stored on the property; refuse chemicals from chemical cleaning were discharged on the ground; and acid washes from boiler cleaners were discharged on the ground, the lawsuit stated.
The employee told Yelley that he took his concerns to the owners of the business, Harold Dugan and Bob Haller, and was told that "that was the way business was conducted in west Texas," the lawsuit stated.
A few days later, the employee told Yelley that the company was moving evidence, and Yelley went to the area and found "many drums" leaking onto the ground and that the area had a "strong, acid smell," the lawsuit stated. When speaking to Dugan, he provided a statement to Yelley that stated that all the materials were not his, and belonged to the previous owner of the property, the lawsuit stated.
After looking at historical satellite data, Yelley determined the barrels had not started to appear until 2004, two years after Plant Maintenance Services began operations, the lawsuit stated.
More employees later approached Yelley and said that the company had been illegally dumping toxic materials and the company had additional environmental issues such as falsified or missing manifest information, and the improper use of another company's waste hauler numbers, the lawsuit stated.
The lawsuit was filed Friday in Travis County.
