HC rap for BSNL over not promoting visually-impaired employee [India] [Times of India]

(Times of India Via Acquire Media NewsEdge) CHANDIGARH: Adopting humanitarian approach while deciding a case, Chief Justice A K Sikri of the Punjab and Haryana high court on Friday gave the "inhumane" public sector telecom giant Bharat Sanchar Nigam Ltd (BSNL) a rap on the knuckles.


Apparently miffed over the attitude of BSNL in not promoting one of its visually impaired employees, Justice Sikri observed, "The respondent employee has lost one eye, but the petitioner BSNL appears to have lost its complete vision".

Justice Sikri also referred a book titled "No Pity", which opens with words "able cannot understand disabled". He also referred to some quotes of Swami Vivekananda on the concept of loss of vision, in his order.

In this case, the employee, Mangat Ram of Ambala Cantt, presently posted as technical assistant, had cleared competitive test for promotion as junior telecom officer (JTO). However, BSNL disqualified him from promotion, citing his being blind in one eye. Aggrieved with BSNL's decision, Mangat Ram moved a petition before the Chandigarh bench of Central Administrative Tribunal (CAT) for justice.

Taking up his petition, CAT, in 2012, ordered BSNL to promote him from the date his juniors were promoted.

Dissatisfied with CAT order, the chief general manager of BSNL based at Sector 34 here had filed an appeal before the Punjab and Haryana high court seeking directions to quash the orders of CAT, which was dismissed by the bench after finding no merit in it and directed BSNL to promote the petitioner to the said post.
