The New York Times recently reported, based on documents unsealed in the first personal injury case to proceed to trial against DePuy, that Johnson & Johnson conducted an internal analysis in 2011 that projected that the device would fai within five years in nearly 40 percent of patients who received it. This analysis was not released to the public at the time it was prepared.

"If DePuy's reported internal analysis proves correct, thousands of patients who were implanted with the ASR hip implant will suffer injuries from the device, including in many cases metallosis and a painful revision surgery," stated Ms. Hazam.
