BRIEF: Police charge man with trying to run family off road

Odessa police arrested a 32-year-old Wyoming man Thursday on a warrant accusing him of attempting to run his ex-wife and children off the road.
On Dec. 19, Mario Alberto Montoya Jr.'s ex-wife was driving in the 2100 block of North Dixie Boulevard, the warrant states, when Montoya side-swiped her vehicle about four times with his black Toyota Tundra.
His children, a 9-year-old girl and a 5-year-old boy, described the assault to a Harmony Home worker in front of police, the affidavit states, and the boy "stated his father tried to run them over."
Montoya's ex-wife had filed a protective order in May 2012, the affidavit states, but it had not been served on Montoya. The affidavit didn't explain why.
The assault happened after Montoya's daughter's birthday party, the affidavit states.
Charges against Montoya include two felony counts of endangering a child and a misdemeanor count of deadly conduct. Montoya, who records show lived in Cheyenne, Wyo., remained on Friday in Ector County Detention Center on a total $40,000 bond.
