BRIEF: Boynton Beach attorney ethics complaint dismissed

Mar 08, 2013 (Sun Sentinel - McClatchy-Tribune Information Services via COMTEX) -- The Palm Beach County Ethics Commission Thursday dismissed a complaint facing Boynton Beach City Attorney James Cherof.

The complaint said that Cherof misused his public position by failing to timely make available a video of an interview of the wife of then-mayor Jose Rodriguez, who in 2012 was suspended from office due to an ongoing public corruption case.


The Ethics Commission on Thursday found that complaint facing Cherof was "legally insufficient" and that there was no proof that Cherof violated the ethics code when it came to a video of interview of Sarah Marquez-Rodriguez.

Jose Rodriguez -- who has declared his innocence -- faces charges of accepting unlawful compensation for official behavior, solicitation to commit unlawful disclosure of a confidential criminal information, and corrupt misuse of official position.

Prosecutors contend that Rodriguez tried to use his position in an effort to block a police investigation into child abuse accusations levied by his estranged wife. The allegations later were determined to be unfounded.
