Headland man to plead guilty in child porn case [Dothan Eagle, Ala.]
(Dothan Eagle (AL) Via Acquire Media NewsEdge) Sept. 01--A Headland man recently submitted a request to withdraw his not guilty plea on multiple federal child pornography-related charges in exchange for a guilty plea.
Federal court records show Matthew Bryon Philmon submitted the request earlier this week in federal court to change his plea on a two-count felony indictment involving the distribution and possession of child pornography.
The court scheduled a change of plea hearing in front of U.S. Judge Wallace Capel Jr. for Sept. 5.
Federal agents submitted a request last month to revoke Philmon's bail after discovering he twice violated the conditions of his bail, which included the possession of a shotgun and multiple laptop computers along with an iPad computer. Records show he was arrested on the bail revocation warrant earlier this month.
As a result, Capel ordered Philmon to remain in custody until his trial.
Records show federal agents originally arrested Philmon in Georgia in April.
Federal court records show the indictment charged Philmon with using a computer peer-to-peer file-sharing program called Limewire on the I nternet to distribute child pornography in Henry County on Dec. 17, 2008.
The second count of the indictment alleged Philmon knowingly possessed a Hewlett Packard Pavilion Entertainment laptop computer with child pornography on it in Henry County on March 10, 2009.
Records show local lawyers Derek Yarbrough, of Dothan, and Spencer Danzey, of Abbeville, were hired to represent Philmon in court.
In an unrelated child pornography case, federal prosecutors with the U.S. Attorney's Office recently filed a felony charge against a man alleging he possessed a computer with images of child pornography on it in Houston County.
Federal court records show prosecutors filed a felony criminal information charge alleging Timothy Dunlap possessed a computer with images of child pornography on it on April 24, 2009 , in Houston County.
