More than 1,300 people were arrested over a 19 day period that included
this year's Labor Day weekend. That's according to the Colorado
Department of Transportation (CDOT). Criminal defense and DUI attorney Nicolas

Darrell Lingk, Director of the Office of Transportation Safety at CDOT,

First, Colorado drivers have the right to record everything that happens
during a traffic stop without having to ask for the officer's
permission. Geman recommends creating an objective record of the events
by using a smartphone to record audio.
Second, Colorado drivers do not have to perform roadside sobriety tests
when stopped for a DUI. Geman recommends that drivers do not perform
them because they are unreliable and can only hurt the driver's case.
Third, because Colorado has DUI express consent laws, refusing to submit
to a breathalyzer or blood test when stopped can result in serious
penalties. Geman recommends asking for a blood test because it is
usually performed at a hospital where witnesses can corroborate the
situation and results.
"Regardless of the circumstances, anyone charged with a DUI needs the
