FERC Order to Brookfield White Pine Hydro, LLC. Regarding Approving Revised As-built Exhibits

ORDER APPROVING REVISED AS-BUILT EXHIBITS
(Issued October 4, 2013)
1. On October 26, 2012, the Brookfield White Pine Hydro, LLC., licensee for the Gulf Island - Deer Rips Hydroelectric Project, FERC No. 2283, filed revised as-built A and F drawings reflecting its replacement of flashboards at the Deer Rips and Androscoggin No. 3 developments. The project is located on the Androscoggin River in Androscoggin County, Maine. The project does not occupy federal lands.
2. On June 3, 2010 the licensee requested approval from the Division of Dam Safety and Inspections - New York Regional Office (NYRO) to install an inflatable gate system over three sections of the spillway at the Deer Rips and Androscoggin No. 3 developments. On June 22, 2010, NYRO gave the approval for the construction and required the licensee to file revised as-built drawings to the Commission 90 days after construction completion. The construction was completed on September 19, 2012. On October 26, 2012, the licensee filed the revised as-built exhibits.
A. Revised As-Built Exhibit A
3. We reviewed the revised as-built Exhibit A, and found it accurately describes the project facilities as-built. The revised exhibit conforms to the Commission's rules and regulations, and is approved in ordering paragraph (A) of this order. In ordering paragraph (B) we revise the project description to reflect the changes to the project.
B. Revised As-Built Exhibit F Drawings
4. We reviewed the revised as-built Exhibit F drawings and found they incorporate the necessary project features and include the as-built conditions of the project. The revised exhibits conform to the Commission's rules and regulations, and are approved, as shown in ordering paragraph (C) of this order. In ordering paragraph (D), we are requiring the licensee to file the approved drawings in aperture card and electronic file formats.
The Director orders:
(A) The revised Exhibit A, filed October 26, 2012, describing the Gulf Island - Deer Rips Hydroelectric Project, is approved and made a part of the license. The previous Exhibit A is eliminated from the license.
(B) The project description in sections (a) and (c) of the Deer Rips and Androscoggin No. 3 Developments, under ordering paragraph (B)(2) of the license, are revised to read as follows:
Deer Rips and Androscoggin No. 3 Developments:
(a) a concrete gravity dam, totaling 932.7 feet long, with a maximum height of 50 feet consisting of: (1) two headgate sections (see below); (2) a concrete wastegate section, about 55.5 feet long, with two gated deep discharge tubes, each seven feet in diameter; and (3) a 715.5-foot-long spillway section, with a crest elevation of 201.45 feet (NGVD), topped with a 4.55 foot-high inflatable dam crest;
(c) the Androscoggin No. 3 Development, consisting of: (1) a 45-foot-long by 38-foot-wide forebay, located on the east end of the dam and leading to the Androscoggin No. 3 powerhouse, with (i) a 3.25-foot-high inflatable rubber dam to elevation 207 feet (NGVD), and (ii) stoplog slots and two steel gates, each measuring 14 feet high by 17.5 feet wide; (2) a concrete, steel, and brick powerhouse, measuring 44 feet wide by 52 feet long, equipped with one vertical fixed-blade turbine-generator unit, having (i) an installed capacity of 3,600 kW, (ii) a hydraulic capacity of 1,775 cfs, and (iii) a rated head of 32 feet; (4) two trashracks having 3/8-inch steel bars at 3-1/2 inch openings; and (5) an excavated tailrace, about 400 feet long by 60 feet wide, with a normal elevation of about 173.0 feet (NGVD);
(C) The following exhibit drawings filed on October 26, 2012, conform to the Commission's rules and regulations, and are approved and made a part of the license.

(D) Within 45 days of the date of issuance of this order, the licensee shall file the approved exhibit drawings in aperture card and electronic file formats.
a) Three sets of the approved exhibit drawing shall be reproduced on silver or gelatin 35mm microfilm. All microfilm shall be mounted on type D (3-1/4" X 7-3/8") aperture cards. Prior to microfilming, the FERC Project Drawing Number (i.e., P-2283-1022) shall be shown in the margin below the title block of the approved drawing. After mounting, the FERC Drawing Number shall be typed on the upper right corner of each aperture card. Additionally, the Project Number, FERC Exhibit (i.e., F-1), Drawing Title, and date of this order shall be typed on the upper left corner of each aperture card. See Figure 1.

Two of the sets of aperture cards shall be filed with the Secretary of the Commission, ATTN: OEP/DHAC. The third set shall be filed with the Commission's Division of Dam Safety and Inspections New York Regional Office.
b) The licensee shall file two separate sets of exhibit drawings in electronic raster format with the Secretary of the Commission, ATTN: OEP/DHAC. A third set shall be filed with the Commission's Division of Dam Safety and Inspections New York Regional Office. The Exhibit F drawings must be identified as (CEII) material under 18 CFR section 388.113(c). Each drawing must be a separate electronic file, and the file name shall include: FERC Project Drawing Number, FERC Exhibit, Drawing Title, date of this order, and file extension [i.e., P-2283-1022, F-1, General Project Plan-Deer Rips and Androscoggin No. 3 Powerhouse, Dam, Canal, MM-DD-YYYY.TIF]. Electronic drawings shall meet the following format specification:
IMAGERY - black & white raster file
FILE TYPE - Tagged Image File Format, (TIFF) CCITT Group 4
RESOLUTION - 300 dpi desired, (200 dpi min.)
DRAWING SIZE FORMAT - 24" X 36" (min), 28" X 40" (max)
FILE SIZE - less than 1 MB desired
(E) This order constitutes final agency action. Any party may file a request for rehearing of this order within 30 days from the date of its issuance, as provided in section 313(a) of the FPA, 16 U.S.C. section 825l (2012), and the Commission's regulations at 18 C.F.R. section 385.713 (2013). The filing of a request for rehearing does not operate as a stay of the effective date of this order, or of any other date specified in this order. The licensee's failure to file a request for rehearing shall constitute acceptance of this order.
