FERC Issues Order Approving Exhibit G Drawing re the Town of Stuyvesant, New York et al Under P-2696

(Targeted News Service Via Acquire Media NewsEdge) WASHINGTON, Dec. 20 -- The U.S. Department of Energy's Federal Energy Regulatory Commission issued the following notice: Town of Stuyvesant, New York and Albany Engineering Corporation Project No. 2696-033 ORDER APPROVING EXHIBIT G DRAWING (Issued December 20, 2013) 1. On September 17, 2013, the Town of Stuyvesant, New York, and Albany Engineering Corporation, licensees for the Stuyvesant Falls Hydroelectric Project, FERC No. 2696, filed for Commission approval a revised Exhibit G drawing pursuant to Article 203 of an Order Issuing New License. On November 21, 2013, the licensees filed supplemental information requested by the Commission. The project is located on Kinderhook Creek in Columbia County, New York. The project does not occupy federal lands.


Background 2. Article 203, in part, requires the licensees to file, within 90 days from the issuance date of the license, revised Exhibit G drawings that identify all principal projects works necessary for the maintenance of the project within the project boundary , including Sandbar Park; Overlook Park; and the proposed canoe/kayak put-in, portage trail around the dam, and an associated parking area. The drawings must comply with sections 4.39 and 4.41 of the Commission's regulations. On September 17, 2013, the licensees filed an Exhibit G drawing for Commission approval.

3. On November 6, 2013, the Commission sent a deficiency letter to the licensees stating that the Exhibit G drawing did not comply with sections 4.39 and 4.41 of the Commission's regulations. The licensees were informed that it had 45 days from the date of the letter to correct and refile the revised Exhibit G drawing for approval. On November 21, 2013, a corrected revised Exhibit G drawing was filed for Commission approval.

Two of the sets of aperture cards shall be filed with the Secretary of the Commission, ATTN: OEP/DHAC. The third set shall be filed with the Commission's Division of Dam Safety and Inspections New York Regional Office.

b) The licensees shall file two separate sets of exhibit drawings in electronic raster format with the Secretary of the Commission, ATTN: OEP/DHAC. A third set shall be filed with the Commission's Division of Dam Safety and Inspections New York Regional Office. Each drawing must be a separate electronic file, and the file name shall include: FERC Project-Drawing Number, FERC Exhibit, Drawing Title, date of this order, and file extension in the following format [P-2696-1011, G-1, Project Boundary Map, MM-DD-YYYY.TIF]. Electronic drawings shall meet the following format specification: IMAGERY - black & white raster file FILE TYPE - Tagged Image File Format, (TIFF) CCITT Group 4 RESOLUTION - 300 dpi desired, (200 dpi min) DRAWING SIZE FORMAT - 24" x 36" (min), 28" x 40" (max) FILE SIZE - less than 1 MB desired Each Exhibit G drawing that includes the project boundary must contain a minimum of three known reference points (i.e., latitude and longitude coordinates, or state plane coordinates). The points must be arranged in a triangular format for GIS georeferencing the project boundary drawing to the polygon data, and must be based on a standard map coordinate system. The spatial reference for the drawing (i.e., map projection, map datum, and units of measurement) must be identified on the drawing and each reference point must be labeled. In addition, each project boundary drawing must be stamped by a registered land surveyor.

Discussion 4. Our review of the revised Exhibit G drawing found it accurately encloses all principal project works necessary for operation and maintenance of the project, and includes the all of the recreation facilities/amenities listed above. We georeferenced the Exhibit G drawing and found it in agreement with our current mapping requirements. The drawing submitted conforms to the Commission's rules and regulations and is approved by this order, as shown in ordering paragraph (A). In ordering paragraph (B), we are requiring the licensees to file the approved exhibit G drawing in aperture card and electronic file formats.

The Director orders: (A) The following Exhibit G drawing filed on November 21, 2013, conforms to the Commission's rules and regulations, and is approved and made part of the license: c) The licensees shall file two separate sets of the project boundary data in a georeferenced electronic file format (such as ArcView shape files, GeoMedia files, MapInfo files, or a similar GIS format) with the Secretary of the Commission, ATTN: OEP/DHAC. The filing shall include both polygon data and all reference points shown on the individual project boundary drawings. An electronic boundary polygon data file(s) is required for each project development. Depending on the electronic file format, the polygon and point data can be included in single files with multiple layers. The georeferenced electronic boundary data file must be positionally accurate to a40 feet in order to comply with National Map Accuracy Standards for maps at a 1:24,000 scale. The file name(s) shall include: FERC Project Number, data description, date of this order, and file extension in the following format [P-2696, boundary polygon/or point data, MM-DD-YYYY.SHP]. The data must be accompanied by a separate text file describing the spatial reference for the georeferenced data: map projection used (i.e., UTM, State Plane, Decimal Degrees, etc.), the map datum (i.e., North American 27, North American 83, etc.), and the units of measurement (i.e., feet, meters, miles, etc.). The text file name shall include: FERC Project Number, data description, date of this order, and file extension in the following format [P-2696, project boundary metadata, MM-DD-YYYY.TXT].

(A) This order constitutes final agency action. Any party may file a request for rehearing of this order within 30 days from the date of its issuance, as provided in section 313(a) of the Federal Power Act, 16 U.S.C. section 825l (2012), and the Commission's regulations at 18 C.F.R. section 385.713 (2013). The filing of a request for rehearing does not operate as a stay of the effective date of this order, or of any other date specified in this order. The licensees' failure to file a request for rehearing shall constitute acceptance of this order.
