It is called the 'Oh crap' app.



The app was designed to tell people what they can and cannot do when being pulled over for suspicion of drunk driving, said Fox News (4.5.14). The central function of the app is the emergency 'Oh Crap' button which is to be hit when a person gets stopped. This large red button activates an audio recording function that can capture up to 15 minutes of conversation. After this time, or when the user hits stop, the recording is then automatically uploaded to a secure server. The purpose of this feature is to save the driver's conversation with the officer should it be needed in future court proceedings.

"A lawyer will be able to access that audio to determine if the driver's constitutional rights were violated," said Katz. "This information may then be able to be used to the driver's advantage when formulating a defense strategy." The app also educates users on their basic legal rights, has a feature that calculates blood alcohol content, gives advice like "shut up" and "be polite," plus, has a button that contacts an on-call lawyer, reported Fox News.


Currently, the app can only be used in states with one-party consent regulations on taping in-person conversations. In states with laws that require two-party consent, all parties must give their consent or at least be notified that the conversation is about to be recorded. Given this, the 'Oh Crap' app recording would only be able to be used in a legal case if all parties being recorded consent to the recording or agree to the disclosure of the contents of the recording.

The planned national version of the app will have a GPS function that determines what recording laws are in the state where the driver is located and the nearest participating attorney.

The 'Oh Crap' app is free and available on both Android and iPhone devices.
