Amtel (News - Alert) today announced that its TIMS cell phone software platform provides the segregation of corporate wireless/mobile/cell phone billing into company vs. personal usage segments. Using TIMS, companies can automatically send the reports to the department heads or end users.
The IRS recently audited some large organizations, making them answerable for millions of dollars worth of back taxes connected to mobile services expenses. The requirements classify mobile phones and pagers as “listed property.” This makes them subject to strict substantiation requirements. Business use of so-called listed property is not included in employee wages, but any personal use is taxable and included. All use of the mobile device is taxable and included if substantiation requirements are unmet.
Adequate records sufficient to establish each element of business use are required by IRS Regulation 1.274-5T(c). In order to meet this requirement, business use of cell phones must be properly backed.
